1. Acceptance of Terms

By accessing, browsing, or making a purchase through the House of Haliya website ("Site"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), together with our Privacy Policy and Return & Refund Policy, all of which are incorporated herein by reference. If you do not agree to these Terms in their entirety, you must not use the Site.

House of Haliya may revise these Terms from time to time. When we do, we will post the updated Terms on this Site and update the "Last Updated" date above. Material changes will not apply retroactively to orders that have already been placed and confirmed before the change takes effect. Your continued use of the Site after the updated Terms are posted constitutes your acceptance of the revised Terms with respect to your future use of the Site and future orders. If you do not agree to a revised version, you must stop using the Site.

2. Eligibility

Any unauthorized use constitutes an infringement of our intellectual property rights and may subject you to civil and criminal penalties under applicable law.

5. Products, Descriptions, and Pricing

We make reasonable efforts to display our products accurately, including descriptions, dimensions, colors, and pricing. However, we do not warrant that product descriptions, images, or pricing are accurate, complete, reliable, current, or error-free. Color representation may vary depending on your device's display settings. Handmade products may exhibit minor natural variations that are inherent to their craft and do not constitute defects.

Prices are displayed and charged in the applicable currency at the time of checkout and are subject to change at any time without prior notice. In the event of a pricing error, House of Haliya reserves the right to cancel any order placed at an incorrect price and will notify you promptly. If payment has already been collected, a full refund of the erroneous charge will be issued.

6. Order Acceptance and Cancellation

Submission of an order through the Site constitutes an offer to purchase and does not create a binding contract until confirmed by House of Haliya. We reserve the right, in our sole discretion, to refuse or cancel any order for any reason, including but not limited to:

• Suspected fraud, unauthorized payment, or abuse of our systems
• Inaccurate or incomplete customer information
• Product unavailability or errors in product or pricing information
• Restrictions under applicable law

If your order is refused or cancelled after payment has been processed, you will receive a full refund to your original payment method.

7. Payment Processing

All payments are processed securely through Shopify's payment infrastructure. House of Haliya does not collect, store, or have direct access to your payment card information. By submitting a payment, you represent and warrant that you are the authorized holder of the payment method used and that the information provided is accurate.

House of Haliya shall not be liable for any errors, failures, or unauthorized transactions arising from Shopify's payment processing systems. Please refer to Shopify's Terms of Service and Privacy Policy for further information.

8. Disclaimer of Warranties

THE SITE, AND ALL PRODUCTS, CONTENT, AND SERVICES PROVIDED THROUGH IT, ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, HOUSE OF HALIYA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

HOUSE OF HALIYA DOES NOT WARRANT THAT: (A) THE SITE WILL BE AVAILABLE, UNINTERRUPTED, OR ERROR-FREE AT ALL TIMES; (B) DEFECTS WILL BE CORRECTED; (C) THE SITE OR ITS SERVER IS FREE OF VIRUSES OR HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SITE WILL MEET YOUR REQUIREMENTS.

California residents: notwithstanding any other provision of this section, nothing in these Terms is intended to disclaim, exclude, or limit any implied warranty, right, or remedy that may not be disclaimed, excluded, or limited under the California Song-Beverly Consumer Warranty Act (Cal. Civ. Code § 1790 et seq.) or any other mandatory California consumer protection law. To the extent any provision of this section conflicts with such mandatory rights, that mandatory right shall prevail.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOUSE OF HALIYA, ITS OWNERS, EMPLOYEES, CONTRACTORS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITY — ARISING OUT OF OR IN ANY WAY CONNECTED WITH: (A) YOUR USE OF OR INABILITY TO USE THE SITE; (B) YOUR PURCHASE OF OR RELIANCE ON PRODUCTS OR SERVICES; OR (C) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR INFORMATION. IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE TOTAL AMOUNT PAID BY YOU TO HOUSE OF HALIYA FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless House of Haliya and its owners, employees, agents, contractors, and affiliates from and against any and all claims, demands, suits, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use or misuse of the Site; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your violation of any rights of any third party.

The Site may contain links to third-party websites and services, including but not limited to social media platforms and Shopify's checkout interface. These links are provided solely for convenience. House of Haliya has no control over the content, privacy practices, or terms of third-party websites and assumes no responsibility or liability for them. Your use of any third-party website is subject to that website's own terms and policies.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed exclusively in accordance with the laws of the State of California and applicable federal law, without regard to conflict of law provisions. You irrevocably consent to the exclusive jurisdiction of the state and federal courts located in the State of California to resolve any dispute or claim arising out of or in connection with these Terms, your use of the Site, or your purchase of products. House of Haliya LLC is organized and operates under the laws of the State of California.

13. Severability
